New injuries resulting from Fen-Phen
If you have already participated in an AHP Fen Phen Settlement for injuries, but your condition has since worsened (this may qualify as progression), you could be entitled to additional monies to compensate your progression claim. Claimants registered with the AHP Trust by May 3, 2003 have either settled or are in the settlement process with Wyeth (formerly American Home Products) after taking Pondimin and/or Redux diet drugs ("fen-phen"). However, injured parties continue medical treatment as they sustain further injuries and experience worsening conditions (heart-valve surgery, stroke, ventricular fibrillation or tachycardia, surgery complications). Many claimants do not know that they are entitled to additional recovery after this initial settlement. Depending on their levels of damages, people who claimed injury with the trust may be eligible for a progression claim. If the injured party initially claimed a low level injury, whether they are a Seventh Amendment or Matrix Level Claim, they are eligible for new settlements should their injury level increase. In times of economic recession, paying for doctor’s visits and medical care is becoming more difficult. The funds released by Wyeth to reward your progression claim can ease your financial burden.
Are you in the Seventh Amendment or Matrix?
If you have already received a settlement or if you were properly and fully submitted to AHP as a “Trust Claim,” then you fall into one of two categories: Seventh Amendment or Matrix. The AHP Trust established two general settlement classes; Matrix level claims who had to opt out of the 7th Amendment in 2004, and those who participate in the Seventh Amendment.
Regardless of class, all valid claimants are able to claim progression that will move them up into a Matrix III, IV, or V level depending on whether they had or needed heart-valve surgery or have experienced a stroke or another post surgical complication. The Settlement Trust will accept Matrix claims until 2015 for those whose condition has worsened since their registration or settlement payment. Claimants who are members of the 7th Amendment to the Class Action Settlement Agreement have until 2011 to file claims with the AHP Settlement Trust for additional money for progression.
